UPDATED BACKGROUND SCREENING DOCUMENTS

In 2010 The Consumer Financial Protection Bureau (CFPB) became the overseeing agency responsible for enforcement of federal consumer protection laws, including the Fair Credit Reporting Act (FCRA). With this new authority in place, the CFPB has made changes to three notices required by the FCRA, effective January 1, 2013. The change directs users of consumer reports (ie. Background checks) as well as furnishers of consumer reports to the CFPB instead of the previous governing agency; the Fair Trade Commission (FTC). To comply with the new law, employers and Consumer Reporting Agencies (CRA's) will need to update their forms/notices by January 1, 2013.

THE FORMS ARE AS FOLLOWS:

1. A Summary of Your Rights Under
the Fair Credit Reporting Act

This notice must be provided to applicants/employees who are subject to a consumer and or investigative consumer report. This notice provides a summary of the applicant's major rights under the FCRA. KENTECH has previously enclosed this Summary of Rights in the sample Disclosure and Release form given to clients upon setup of an account. You must replace the previous version of the FCRA Summary of Rights with the revised version by January 1, 2013. 2. Notice to Users of Consumer Reports:
Obligations of Users Under the FCRA (download here): (For Employers)
The Fair Credit Reporting Act (FCRA), 15 U.S.C. 1681-1681y, requires that this notice be provided to inform users of consumer reports (such as employers) informing them of their legal obligations. This notice has been previously sent out to KENTECH clients upon setup of an account with KENTECH, (enclosed in your KENTECH End-User Agreement). Please make sure to print and read the document to ensure obligations are being met in regard to consumer reports (ie. Permissible purpose under the FCRA to obtain a consumer report). 3. Notice to Furnishers of Information:
Obligation of Furnishers Under the FCRA (download here): (For Furnishers)
Under the Fair Credit Reporting Act (FCRA), 15 U.S.C. 1681-1681y, responsibilities are imposed on all persons who furnish information to Consumer Reporting Agencies (CRA's), which may include firms hired to conduct background screening checks. This notice requires furnishers of information to be familiar with applicable laws and comply with federal guidelines and regulations dealing with the accuracy of information provided to CRA's. These responsibilities are found in Section 623 of the FCRA, 15 U.S.C. 1681s-2. State law may impose additional requirements on furnishers.
